These Terms of Service (“Terms”) govern your access to and use of the 4Viso platform, website, APIs, and related services (collectively, the “Platform”), operated by 4Viso BV (“4Viso,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1. Overview of Services
4Viso provides a global SaaS solution for shipping lane risk management and supply chain auditing. The Platform enables users and Logistics Service Providers (“LSPs”) to create organization profiles, analyze risk data, and share information based on configurable permissions.
2. Eligibility & Account Registration
- You must be at least 18 years old and authorized to act for your organization.
- You are responsible for maintaining the confidentiality of your login credentials.
- 4Viso reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
3. User Data & Visibility
- Ownership: You retain ownership of all data you upload (“User Data”).
- License: You grant 4Viso a non-exclusive, worldwide, royalty-free license to host and process your data to provide the Platform.
- Visibility: Certain organization profile information (e.g., name, logo, certifications) may be public. Other data remains private per your visibility settings.
4. Public Information
Publicly marked data may appear on our website or be indexed by search engines. 4Viso cannot control external reuse of such public data.
5. Acceptable Use
You agree not to:
- Upload unlawful, misleading, or harmful content;
- Attempt to breach or disrupt the Platform’s security;
- Scrape or mine data without authorization;
- Violate any applicable trade, privacy, or export laws.
6. Intellectual Property
All Platform IP, including code, design, and content (excluding User Data), belongs to 4Viso BV. You receive a limited, revocable license to use the Platform for lawful business purposes.
7. Subscriptions, Payment & Billing
Paid subscriptions are billed in advance on a recurring basis. Payments are non-refundable except where required by law. Pricing changes will be notified 30 days in advance.
8. Service Level Agreement (SLA)
4Viso targets 99.5% monthly uptime, excluding scheduled maintenance, third-party failures, or force majeure. Enterprise clients may request an SLA with extended support terms.
9. Audit & Compliance Support
Upon request, 4Viso provides security audit records and compliance documentation (e.g., ISO, SOC 2). Such information is confidential and may not be publicly disclosed.
10. Data Protection & Privacy
4Viso complies with GDPR, CCPA, and related global data protection laws. A Data Processing Agreement (DPA) is available upon request for enterprise clients.
11. Third-Party Services
4Viso may integrate third-party tools or APIs. 4Viso is not responsible for their availability, content, or security practices.
12. Confidentiality
Each party shall keep non-public information confidential and use it only for fulfilling these Terms, except where disclosure is required by law.
13. Disclaimer of Warranties
The Platform is provided “as is” and “as available.” We make no warranties regarding performance or suitability for a particular purpose.
14. Limitation of Liability
To the extent permitted by law, 4Viso is not liable for indirect or consequential damages. Total liability shall not exceed the total fees paid by you in the 12 months preceding a claim.
15. Termination
4Viso may suspend or terminate access for violation of these Terms, non-payment, or unlawful activity. Upon termination, your data is handled per our retention policy.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of Belgium. Any dispute shall first be resolved through good-faith negotiation. If unresolved, it shall be finally settled by arbitration in Antwerp, Belgium, under the rules of CEPANI (Belgian Centre for Arbitration and Mediation). The arbitral decision shall be final and binding.
17. Modifications
4Viso may update these Terms periodically. Continued use after notice constitutes acceptance of the revised Terms.
